Hatch Amendment would Empower Congress to Protect American Flag

Sens. Orrin Hatch and Max Baucus introduce a constitutional amendment that would restore to Congress the right to protect the American flag from acts of physical desecration.

"This amendment gives Utahns and other Americans an opportunity to assert their rightful authority over the Constitution," Hatch said. "The Supreme Court was wrong to say that flag desecration was protected speech, and the American people should be able to say so. The Stars and Stripes is a symbol of our national unity, and the people’s elected representatives should be allowed to protect it."
