Utah House Democrats respond to court decision on ‘Utah Fits All’

The Utah House Democratic Caucus issued the following statement in response to the 3rd District Court’s ruling declaring the Utah Fits All program unconstitutional:

“We are grateful for the recent ruling from the 3rd District Court declaring the Utah Fits All voucher program unconstitutional. Utah Fits All lacks the oversight and accountability required of public schools yet still draws from taxpayer funds to benefit only a select few. This decision reinforces a core principle of our democracy: public funds must be used to support a strong, inclusive public education system accessible to every child in Utah.

While we acknowledge that state leaders have signaled their intent to appeal, we urge all parties to respect the integrity of our judicial system. Court decisions grounded in constitutional interpretation are not examples of judicial activism—they are essential expressions of our system of checks and balances.

We remain steadfast in upholding the Utah Constitution and protecting public education as a cornerstone of opportunity for all children, regardless of their background.”
